Trademarks. The Content includes logotypes, trademarks, and service marks (collectively “Marks”) owned by PG and its affiliated companies, and Marks owned by other information providers and third parties. You may use Marks only after such use is approved in advance by PinnacleGirl.com.

Links to, and frames of, PinnacleGirl.com. If you operate a Web site and wish to link to PinnacleGirl.com, you may link only to the home page, www.PinnacleGirl.com, and not to any other page or subdomain of PinnacleGirl.com. Framing Content is forbidden, as is decompiling, reverse engineering, or disassembling any software or other products or processes accessible through PinnacleGirl.com. Data mining, robots, cancelbots, Trojan horse, or any data gathering or extraction method is also forbidden.

Membership and Registration. You must provide only true, accurate, current, and complete information whenever you register or otherwise correspond with PinnacleGirl.com. You agree that PinnacleGirl.com may use your information as set forth in the Privacy Policy.

A member is responsible for all use of the account or password. You may not sell, transfer, or assign your Membership or any Membership rights. You must maintain the confidentiality of your password and must not permit others to use your account. PinnacleGirl.com reserves the right to terminate Membership and deny access to the site to any person who violates this Terms of Service.

A member is also responsible for ensuring that the member’s use of PinnacleGirl.com complies with all local rules regarding online conduct and acceptable Content, including without limitation laws regarding the transmission of technical data from the country in which the member resides and/or uses PinnacleGirl.com.

Services For Customers:

Pinnacle Girl allows Subscribers to transmit data to various financial networks and telecommunication networks for settlement. In order to enroll in such services, the Subscriber must (i) be at least 18 years of age; (ii) populate every field on every form presented to User with accurate data; (iii) have a valid e-mail address; and (iv) agree to be bound by the TOS or any other agreement governing User's use of the service or particular resource described in the preceding sentence. User's failure to populate every field may result in User's waiver of certain rights under the TOS or other applicable agreements.

   1. Credit/Debit Card Authorization:

By submitting credit or debit card ("Bank Card") data to Pinnacle Girl, User authorizes Pinnacle Girl in its sole discretion to submit financial transactions to such User's issuing bank for settlement. User agrees that once Pinnacle Girl has approved or declined the User's transaction, Pinnacle Girl has fully performed under the terms of the TOS or other applicable agreements.

Each User who authorizes payment of a recurring charge (including without limitation subscription fees payable by a Subscriber) by Bank Card agrees to contact Pinnacle Girl in the event such User desires to cancel any such recurring charge, all within ten (10) days prior to the next billing cycle. Should User fail to contact Pinnacle Girl within such time frame, User agrees to indemnify and hold Pinnacle Girl harmless from any losses or damages that User suffers as a result of such recurring charge.

If a User believes that there is an error on User's Bank Card statement arising from or related to a transaction authorized by User, including an incorrect amount or unauthorized transaction reflected on User's Bank Card statement or transaction summary, User agrees to contact Pinnacle Girl within the time periods set below. Upon proper notification, Pinnacle Girl, in its sole discretion, may issue a credit to User's Bank Card:

          * United States Issued Bank Cards-- within 120 days of the transaction.
          * International Issued Bank Cards-- within 180 days of the transaction.

      Monthly / Yearly memberships are processed through PayPal, and can be contacted online at PayPayl.com

   2. ACH Debit Authorization

By submitting a User's checking account data to Pinnacle Girl User authorizes Pinnacle Girl in its sole discretion to submit financial transactions to such User's depository bank for settlement. User agrees that once Pinnacle Girl has approved or declined the User's transaction, Pinnacle Girl has fully performed under the terms of the TOS or other applicable Agreement.

If a User believes that there is an error on User's checking account statement arising from or related to a transaction authorized by User, including an incorrect amount or unauthorized transaction reflected on User's checking account statement or transaction summary, User agrees to contact Pinnacle Girl within two (2) business days after learning of such error. Upon proper notification, Pinnacle Girl, in its sole discretion, may issue a credit to User's checking account.

User-Created Content. By placing material on, or communicating with, PinnacleGirl.com, you represent and warrant that you own or otherwise control all of the rights to the content that you provide, have the right to transmit the content you transmit, that the content is accurate, that it does not violate these Terms of Service, and that it will not cause injury to any person or entity. You grant PG, its affiliates and related entities, including PinnacleGirl.com, a royalty-free, perpetual, irrevocable, non-exclusive, right and license to use, copy, modify, display, archive, store, distribute, reproduce, and create derivative works from all information you provide to us, in any form, media, software, or technology of any kind now existing or developed in the future. Without limiting the generality of the previous sentence, you authorize PG to include the information you provide in a searchable format that may be accessed by users of PinnacleGirl.com and other PG Web sites. You also grant PG and its affiliates and related entities the right to use your name and any other information about you that you provide in connection with its use and with the reproduction or distribution of such material, and also grant PG the right to use any material, information, ideas, concepts, know-how, or techniques contained in any communication you send to us for any purpose whatsoever, including but not limited to developing, manufacturing, and marketing products using such information. Furthermore, you agree that you shall not transmit any Content that is: unlawful, harmful, threatening, abusive, pornographic, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful or racially, ethnically or otherwise objectionable, harms minors or any person in any way, is unsolicited or unauthorized advertising, is “junk mail,”or “spam,” is a chain letter, is pyramid scheme, is a solicitation, or harasses or stalks another member. PinnacleGirl.com reserves the right to immediately terminate the membership of anyone who violates this provision.

Content Created by Licensed Therapists: PinnacleGirl.com posts Content that is responsive to a personal development or emotional well-being issue submitted by a member. The Content includes information from a therapist licensed by the State of California. By submitting an issue for inclusion in this portion of the website and/or by reading and/or viewing any of the responsive Content, you hereby expressly acknowledge that you are not entering into a therapist-client relationship and that the therapist is not providing professional services. Additionally, all such Content is for informational purposes only and is intended only for the entertainment purposes of our members. Miscellaneous: PG reserves the right to change these Terms of Service at any time. PG will notify you of changes by posting the new Terms of Service on the site. By using the site after the new Terms of Service are posted constitutes your acceptance of the new terms. PG may modify, suspend, discontinue, or restrict the use of any portion of PinnacleGirl.com, including the availability of any portion of the Content at any time, without notice or liability. PG may deny access to any person or user at any time for any reason. In addition, PG (or PinnacleGirl.com) may at any time transfer its rights and obligations under this Agreement.

These Terms of Service will be governed by and construed in accordance with the laws of the State of California, without regard to its conflicts of law provisions. You hereby agree that any cause of action you may have with respect to PinnacleGirl.com must be filed in a federal or state court located in San Diego County, California within two months of the time in which the events giving rise to such claim began, or you agree to waive such claim. If for any reason any provision of this Agreement is found unenforceable, that provision shall be enforced to the maximum extent permissible so as to effect the intent of the parties as reflected in that provision, and the remainder of the Agreement shall continue in full force and effect.
